These Terms & Conditions govern bookings made with Zuru Tena Adventures Limited (“we”, “us”, “our”) for safaris, tours, activities, accommodation, transportation, and related travel services.
By submitting a booking, making a payment, or participating in a safari or activity arranged by Zuru Tena Adventures Limited, you confirm that you have read, understood, and agreed to these Terms & Conditions.
1. Bookings and Inquiries
We offer both ready-to-book safari packages and customized safari experiences.
For customized safaris, an inquiry does not constitute a confirmed booking. We will review your requirements and provide a quotation and proposed itinerary based on availability, dates, accommodation, activities, transportation, and other requested services.
A booking becomes confirmed only after we receive the required payment and issue a booking confirmation.
All bookings are subject to availability at the time of confirmation.
2. Safari Quotations
Quotes are based on the information available at the time of quotation and may be subject to change before booking confirmation.
Accommodation, park fees, transportation, flights, activities, and other supplier costs may change depending on availability and applicable rates.
A quotation is valid for [7/14/30 days], unless otherwise stated on the quotation.
Once a booking has been confirmed and paid for, the agreed price will apply except where additional costs arise from circumstances outside our reasonable control, including government taxes, park or conservation fees, supplier price changes, fuel surcharges, exchange-rate fluctuations, or changes requested by the client.
3. Booking Confirmation and Deposit
To confirm a safari booking, a deposit of [30%] of the total safari cost is required.
The remaining balance of [70%] must be paid no later than [30/45/60] days before the safari start date.
For bookings made within [30/45/60] days of departure, full payment may be required at the time of confirmation.
Certain services, including flights, park permits, special accommodation, or other supplier services, may require full payment in advance and may have separate cancellation conditions.
A booking is not guaranteed until the required payment has been received and confirmation has been issued by Zuru Tena Adventures Limited.
4. Payment Methods
We may accept payment through the payment methods stated on the quotation or booking invoice, which may include:
Credit or debit card
Bank transfer
Mobile money
Online payment
Other payment methods approved by Zuru Tena Adventures Limited
Any applicable bank, card-processing, currency-conversion, or transaction fees will be communicated to the client where applicable.
The booking will be considered paid only when the required funds have been successfully received.
5. Cancellation by the Client
Cancellation requests must be submitted to us in writing.
Cancellation charges are based on the date we receive the cancellation notice and the costs already committed to accommodation providers, airlines, parks, camps, guides, transport providers, and other suppliers.
Unless otherwise stated on your booking confirmation, the following cancellation schedule applies:
More than [60] days before departure: [Deposit retained / applicable supplier charges deducted]
[31–60] days before departure: [50%] of the total booking cost
[15–30] days before departure: [75%] of the total booking cost
Less than [15] days before departure: [100%] of the total booking cost
No-show: 100% of the total booking cost
Some services may have stricter cancellation conditions. Where these apply, the specific conditions will be communicated to the client.
We recommend purchasing comprehensive travel insurance that includes trip cancellation and interruption cover.
6. Refunds
Where a refund is applicable, the refundable amount will be calculated after deducting applicable cancellation charges, supplier penalties, transaction fees, and other non-refundable costs.
Refunds will normally be processed within [30/60/90] days after the refund has been approved and the required funds have been received from relevant suppliers.
No refund will normally be provided for unused portions of a safari resulting from late arrival, missed activities, voluntary itinerary changes, early departure, or failure to use booked services.
7. Changes Requested by the Client
We will make reasonable efforts to accommodate requests to change a confirmed itinerary.
Changes may include:
Travel dates
Accommodation
Number of travelers
Activities
Transportation
Safari duration
Destinations
Room arrangements
Any additional costs resulting from a requested change will be payable by the client.
Changes may also be subject to cancellation charges or fees imposed by our suppliers.
We cannot guarantee that every requested change will be possible.
8. Changes by Zuru Tena Adventures Limited
We reserve the right to modify an itinerary where reasonably necessary due to weather, road conditions, wildlife conditions, park regulations, accommodation availability, safety concerns, government restrictions, flight changes, or other circumstances beyond our reasonable control.
Where possible, we will provide an alternative arrangement of a similar standard.
We will make reasonable efforts to ensure that any necessary changes have the least possible impact on the client’s safari experience.
9. Safari Prices and Inclusions
Each safari quotation or booking confirmation will specify what is included and excluded.
Depending on the package, inclusions may include:
Accommodation
Meals
Safari vehicle and driver-guide
Park and conservation fees
Airport transfers
Activities
Internal transportation
Selected excursions
Unless specifically stated in the itinerary, the following may be excluded:
International flights
Visas
Travel insurance
Personal expenses
Alcoholic beverages
Tips and gratuities
Laundry
Souvenirs
Optional activities
Additional accommodation
Personal medical expenses
The final inclusions and exclusions stated on your booking confirmation take precedence.
10. Accommodation
Accommodation is subject to availability.
Where the accommodation originally selected becomes unavailable, we may provide alternative accommodation of a similar or comparable standard.
Room categories, meal plans, child policies, check-in requirements, and cancellation conditions may vary between accommodation providers.
Special accommodation requests should be communicated at the time of booking.
11. Travel Documents, Visas and Entry Requirements
Clients are responsible for ensuring that they have valid passports, visas, permits, vaccination certificates, travel documents, and any other documents required for their journey.
We may provide general information about visa and entry requirements, but clients should confirm current requirements with the relevant government authorities or embassy before travelling.
Zuru Tena Adventures Limited is not responsible for losses resulting from a client’s failure to obtain the required travel documentation.
12. Travel Insurance
We strongly recommend that all clients obtain comprehensive travel insurance before travelling.
Insurance should, where appropriate, cover:
Medical expenses
Emergency evacuation
Trip cancellation
Trip interruption
Lost or damaged baggage
Personal belongings
Delays
Other travel-related risks
Clients participate in safari and adventure activities at their own responsibility and should ensure that their insurance covers the activities included in their itinerary.
13. Health and Safety
Clients are responsible for informing us of any medical condition, mobility limitation, dietary requirement, allergy, or other circumstance that may reasonably affect their participation in the safari.
Certain safari activities may involve inherent risks associated with wildlife, outdoor environments, road travel, hiking, water activities, or other adventure experiences.
Clients must follow the reasonable instructions of guides, drivers, accommodation staff, and activity providers.
We reserve the right to restrict participation in an activity where we reasonably believe that doing so is necessary for the safety of the client, other guests, staff, or service providers.
14. Wildlife and Natural Environment
Wildlife sightings cannot be guaranteed.
Animals move freely within their natural environment, and safari routes and viewing opportunities may vary.
We do not guarantee sightings of any particular animal or species.
Clients must follow park and conservation-area rules and must not attempt to approach, feed, disturb, or otherwise interfere with wildlife.
15. Force Majeure
Zuru Tena Adventures Limited will not be liable for failure or delay in providing services where such failure or delay results from circumstances beyond our reasonable control.
These circumstances may include:
Extreme weather
Natural disasters
Floods
Fire
Epidemics or pandemics
Government restrictions
Political unrest
Civil disturbance
Road closures
Strikes
Security incidents
Changes or cancellations by airlines or suppliers
Park or conservation-area closures
Other unforeseeable circumstances beyond our reasonable control
Where possible, we will assist clients in making alternative arrangements.
Any refunds will be subject to the amounts recoverable from suppliers and the applicable booking and cancellation conditions.
16. Liability
We will take reasonable care in arranging the services included in your booking.
However, we are not responsible for losses, delays, injuries, illness, damage, theft, or expenses arising from circumstances beyond our reasonable control or from services provided directly by independent third-party suppliers.
Our liability, where applicable, will be subject to the limitations permitted under the applicable laws of Kenya.
Nothing in these Terms & Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.
17. Personal Belongings
Clients are responsible for their personal belongings throughout the trip.
Zuru Tena Adventures Limited is not responsible for loss, theft, or damage to personal belongings except where liability cannot lawfully be excluded.
Clients should avoid carrying unnecessary valuables and should maintain appropriate travel insurance.
18. Children
Children are welcome on selected safaris and activities, subject to the policies of the relevant accommodation providers, parks, airlines, and activity operators.
Child rates and age restrictions may vary depending on the itinerary.
The client is responsible for providing accurate ages of all children travelling.
19. Photography and Media
During our safaris and activities, photographs or videos may occasionally be taken for marketing or promotional purposes.
Where required, we will seek appropriate permission before using identifiable images of clients for promotional purposes.
Clients may notify us if they do not wish to appear in promotional photographs or videos.
20. Complaints
We aim to provide a high standard of service.
If a problem occurs during your safari, please notify your Zuru Tena Adventures Limited representative, guide, driver, accommodation manager, or relevant service provider as soon as reasonably possible.
Giving us the opportunity to resolve a problem during the trip allows us to take reasonable corrective action.
Complaints that remain unresolved should be submitted to us in writing as soon as possible after completion of the trip.
21. Website Information
We make reasonable efforts to ensure that information published on our website is accurate and up to date.
However, photographs, descriptions, prices, itineraries, availability, accommodation information, and other website content may change without notice.
The itinerary and booking confirmation issued to the client will contain the specific details applicable to the confirmed booking.
22. Website Use
Users agree not to misuse our website, attempt unauthorized access, interfere with website functionality, introduce malicious software, or use website content for unlawful purposes.
All website content, including text, photographs, graphics, logos, branding, and other materials, is protected by applicable intellectual-property laws unless otherwise stated.
23. Privacy
We collect and process personal information necessary to respond to inquiries, process bookings, arrange travel services, communicate with clients, and provide our services.
Personal information will be handled in accordance with our Privacy Policy and applicable data-protection laws.
24. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Kenya.
Any dispute arising from a booking or service provided by Zuru Tena Adventures Limited shall be handled in accordance with the applicable laws and dispute-resolution procedures of Kenya.
25. Amendments
Zuru Tena Adventures Limited reserves the right to update these Terms & Conditions from time to time.
The version applicable to a confirmed booking will be the version accepted by the client at the time of booking, unless otherwise required by law or agreed in writing.
